IRS Form SS-8
The form that the IRS has used since 1997 to determine whether you are a contractor or employee. Note that your state employment tax agency may use a different, though probably related, test. Also note that in legal matters other than taxes, the test is far simpler: if a company has the right to control or change your work goals and the manner and means by which you achieve them, you're an employee. It was this simple test that proved the undoing of Microsoft in the recently-settled permatemp lawsuit.
